Using the familiar fact pattern of an undue influence bequest case as a matrix, this webinar offers practical guidelines for charities on the risks, benefits and strategies of bequest litigation. Sometimes, charities initiate these cases. But more often, they are forced into them. Attendees will come away with an enhanced understanding of the difference between “bequest cultivation” and “undue influence” and the specific behaviors that put the charity at risk of being an “undue influencer.” We’ll also consider the pros and cons of entering into litigation: deciding whether to take the plunge.

Andrew Fussner is national Vice President of Estate Settlement for the American Heart Association and oversees the administration of $75 to $100 million in bequest assets annually for the organization. He is based in St. Petersburg, Florida. Before assuming his current position he served as the Vice President of Planned Giving for the AHA’s Florida Affiliate and as the AHA’s Director of Planned Giving for the west coast of Florida. Prior to joining the AHA, Andy was an attorney with the Tampa office of the national law firm of Foley & Lardner. He specialized in estate planning, probate/trust administration and tax law. He holds his law degree from the University of Florida. He also obtained a B.S. in Accounting and a B.A. in Political Science from the University of Florida.

Linden Nash (“Lindy”) is the Senior Bequest Attorney in the Bequest Management practice at Chisholm Chisholm & Kilpatrick. Her practice focuses on representing national charities and nonprofit organizations in fulfilling the wishes of their charitable donors while maximizing gifts and minimizing any administrative burden. She oversees the day-to-day operations of the practice and ensures that each client’s matured bequests are handled efficiently while fulfilling the duty of good stewardship. Lindy first joined CCK in 2016 as a Litigation Associate. She litigated on behalf of disabled veterans and their families before the United States Court of Appeals for Veterans Claims and before the Department of Veterans Affairs. Lindy graduated from Connecticut College in 2011 earning a B.A. in both Psychology and Sociology. She then attended Suffolk University Law School and received her JD in 2015. Prior to joining CCK, Lindy served as a judicial law clerk in the Rhode Island Supreme Court Law Clerk Department where she assisted numerous judges with research, dispositive motions, and bench decisions. Lindy is passionate about charity work. She currently helps animals and families in need by serving on the Board of the Providence Animal Rescue League (“PARL”) as the Interim Vice President. She also enjoys reading, traveling and spending time with friends and family.
